Sign on as a plaintiff in a lawsuit against Colgate University
Many alumni, including leadership from all the various
Greek organizations, have told us they voted for the sale of their house
because they believed they had no option. They had a “gun to their
head” and felt they had not choice but to acquiesce to the Colgate
bully. NY law enables a derivative action to be commenced
on behalf of an alumni organization. Five percent of the known members
can bring the lawsuit.
The suit is based on several causes of action. By compelling
the sale of the Greek houses as a result of wrongful threats, Colgate
has denied the legal use allowed for the privately owned fraternity house,
thereby causing economic distress and violating a property right.
By sanctioning students with non-recognition of their chapter
and by threatening suspension and expulsion for association with a banned
chapter, Colgate has breached their own Code of Student Rights and Responsibilities.
As a plaintiff, your responsibilities are limited. In the
unlikely instance you might be deposed, our attorneys would file a motion
of protective order that would allow depositions to be taken over the
telephone or by videoconference.
Legal fees will be covered with alumni donations through
Students & Alumni for Colgate, Inc. (www.sa4c.com)
Kevin Hulslander of Smith Sovik Kendrick & Suget of Syracuse and Jim
Bain of Benjamin, Bain & Howard LLC of Denver have been retained to
fight for Greek property rights.
A lawsuit by your Greek-letter alumni would be similar to
that of Phi Delta Theta v Colgate University.
